Welcome to LocaleTerroir. These Terms of Use (Terms) govern your access to and use of the website at localeterroir.com and any related services, features, and content (the Site). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site. The Site is currently operated by Ana Huson, doing business as LocaleTerroir, as a sole proprietorship, with the intent to transition to a California limited liability company prior to commercial launch (LocaleTerroir, we, us, or our).
By accessing or using the Site in any way (browsing, submitting forms, reviewing your business's pages, sharing a route, or otherwise interacting with our content), you agree to these Terms and our Privacy Policy. If you are using the Site on behalf of a business or organization, you represent that you have authority to bind that entity, and you means both you and that entity.
LocaleTerroir is a curated editorial guide to Sonoma County: its wineries, restaurants, hotels and rentals, transportation, events, wine walks and things to do. All selections, routes and editorial commentary reflect the editorial judgment of LocaleTerroir. Restaurant selections are informed by neighbors: people who live and work in Sonoma County. Editorial content is opinion, not a statement of fact, and is not a guarantee of quality, safety, or any other outcome. Inclusion or exclusion of a business is at LocaleTerroir's sole editorial discretion.
3.1 Our Content: all content on the Site, including editorial writing, graphics, logos, design, and the overall look and feel, is owned by or licensed to LocaleTerroir and protected by intellectual property law. AI-produced placeholder images are provided for illustration; to the extent they are protected, those rights belong to LocaleTerroir. You may not copy, reproduce, distribute, publish, or create derivative works from our content without our prior written permission. 3.2 Submitted Content: businesses may send us photographs, names and roles of team members, and other details to publish with their editorial, or authorize us to select them from a website they identify. When you send us content, you confirm that you have the right to share it, and you grant LocaleTerroir a non-exclusive, royalty-free license to publish it on the Site and in LocaleTerroir materials alongside your editorial. You keep ownership and may use your content anywhere else. You can ask us to remove it at any time by writing to contact@localeterroir.com. 3.3 Fair Use and Editorial Commentary: LocaleTerroir may reference third-party trademarks and awards (such as Michelin stars or James Beard recognition) descriptively, in an editorial capacity, without implying endorsement or affiliation.
3.4 Images on LocaleTerroir: the images on LocaleTerroir pages are AI-produced, county- and industry-inspired placeholder images directed by the LocaleTerroir Production Team. They do not show, and do not belong to, the business on the page. Each featured business may send its own photographs to replace them, or ask us to remove them, at contact@localeterroir.com.
You may use the Site for personal, non-commercial purposes such as discovering places in Sonoma, reading editorial content, building and sharing routes, and reviewing or updating the pages of a business you operate or represent. You agree not to: scrape, crawl, or harvest content using automated means without our prior written consent, except for search engines and AI assistants that follow our robots.txt and llms.txt and link back to the Site; resell, sublicense, or redistribute any portion of the Site or its content; reverse-engineer, decompile, or gain unauthorized access to any portion of the Site or its services; transmit malware, spam, or content that is unlawful, infringing, defamatory, or misleading; impersonate any person or business, or misrepresent your affiliation; or interfere with the normal operation of the Site or others' use of it.
Certain features, such as reviewing your business's pages, sending photos, or sharing a route, may ask for your name or email address. You agree to provide accurate information.
Listings in LocaleTerroir are free. Businesses cannot pay for inclusion, placement, or coverage, and nothing in the guide can be bought. We may offer paid services to organizations, such as custom route production or route content for tourism boards and event planners. These never buy inclusion, placement, or editorial treatment, and their terms are agreed separately in writing.
The Site may link to third-party websites, reservation platforms, ordering services, or other services we do not operate. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to that party's terms.
The Site and all content are provided as is and as available, without warranties of any kind. To the fullest extent permitted by law, LocaleTerroir disclaims all warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation. We do not warrant that restaurant or winery information (hours, menus, prices, availability) is current; confirm directly with the business.
To the fullest extent permitted by law, LocaleTerroir and its owners, employees, and contributors are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill. Total aggregate liability will not exceed the greater of (a) the amounts you paid LocaleTerroir in the 12 months preceding the claim, or (b) USD $100. Some jurisdictions do not allow certain limitations, so some may not apply to you.
You agree to defend, indemnify, and hold harmless LocaleTerroir and its owners, employees, and contributors from claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from (a) your use of the Site, (b) your violation of these Terms, (c) content you submit, or (d) your violation of any third-party right.
We may suspend or terminate your access at any time, for any reason, with or without notice. You may stop using the Site at any time. The Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law sections survive termination.
These Terms are governed by California law, without regard to conflict-of-laws principles. Disputes will be resolved exclusively in the state or federal courts located in Sonoma County, California, and you consent to personal jurisdiction there.
We may update these Terms. Material changes will be posted with a new Last updated date. Continued use after changes take effect constitutes acceptance.
